Shield was retained by a national law firm to investigate a release at a dry cleaning facility located in a shopping center. The client was alleged to have had a release from a delivery vehicle that delivered PCE to the facility. The plaintiff was seeking $10 Million in damages. Due to Shield’s extensive knowledge of dry cleaning operations, we were retained to provide expert witness testimony and opinon as to the likelihood of the alleged cause of release. Shield documented subsurface conditions through extensive subsurface investigation and determined that the most likely source of the release was from disposal of PCE-contaminated materials in an on site dumpster.
Shield’s rapid mobilization to the site and off-peak scheduling of investigation activities enabled data to be collected without disruption to the existing dry cleaning operations. Our understanding of chlorinated solvent behavior enabled the client to avoid extensive litigation and penalties. No award of damages was imposed on our client in this case.
